Meeting Minutes 16 November 2015

Minutes of the Parish Council meeting held on MONDAY 16th NOVEMBER, 2015 at 6.30pm upstairs in the Council Chamber, Town Hall.

Inspector to send a written report if no police can attend.


A gentleman spoke about an update regarding improvements to Warsop Parish and asked about planting more trees in the Town centre.


In response to question about tree planting in town centre the Chairman explained history of trees and market cross. Trees planted in Nisa (Boyes) car park were vandalised and Market Cross couldn’t be located there either as it would result in loss of car parking spaces. Cross is located on Donney Hill on the A60. He also explained that pavements were flagged and widened with extra street furniture, however the railings and other street furniture was in need of re painting. He also stated that the 3 tier planters were not on show this summer, so the Parish Council will put pressure on MDC to do better next year.

Cllr Cockroft has organised improvements for High Street car park (Next to the computer shop). Cllr Adey has spoken to Andrew Nesbit (community payback team) about improvement to the shops in the spring. Cllr Adey will speak to Sheila Shields with regards to hanging baskets purchased by Friends of Meden Vale.

The CCTV system is now up and running but there are problems with pictures front camera is on time delay of about 30 seconds (apparently this is due to laptops). CCTV contract needs to be checked. Cllr Kerr and Crawford to liaise with Mike (Infotech). Cllr J. Cockroft, P. Crawford, J. Kerr and S. Dale (if he can attend) will help with training for volunteer Damien Hilton.


Cllr Adey has offered to deliver W&DN to Gleadthorpe cottages as this was identified as a gap in delivery due to Councillor John Allin's illness.


Cllr Cockroft gave an update and informed the council of 3 new committee members that have joined Warsop Carnival. Cllr Hardy stood down as secretary.


No updates - ask for a report.


The website is now up and running. This needs to be kept updated and current councillors to feed information to the Clerk.


Chase up Shaping Futures for permission.

9395. Tudor Barn

The Chairman informed Council that church has been given 3 weeks’ notice of loss of use of car park behind the Tudor Barn. This matter was in the hands of church solicitor. Car park was gifted and has been in use since the 1970's.

9396. Supermarket Update

Cllr Crawford took in the petition about the cinema building to Mansfield District Council. No planning application received. The purpose of the petition was to aid MDC in there pre planning negotiations with Netto, hopefully the planning application, when it is lodged, will include the demolition of the old cinema and access to the new store from the A60. Boyes has now moved into the old Nisa building. The store opened on Friday 13th November 2015 and sells a wide range of products. The Chairman will write a welcome to the store manager.

9397. F&GP meeting

Minutes of the meeting held on Monday 9th November 2015. Chairman took points and these were ratified by the Council. Chairman put points:

545 Peninsular

Council agreed to use MDC HR Services at the hourly rate of £23 per hour.

546 NALC

Council agreed to give 3 months’ notice to terminate contract with NALC.

547 Living Wage & 548 Contracts of Employment

As items involved staff contracts, Clerks terms and conditions together with confidential information. For this reason the Chairman moved these items to the end of the meeting, press and public would be excluded under the Local Government (Miscellaneous Provisions) act 1972 - paragraph 1 and 3.

None other than a letter Re: car park at Tudor Barn, The Chairman had this put on as agenda item 9395.


No update as Cllr J. Allin is still unwell.

  • Nettleworth Cottage, Leeming Lane North, Mansfield Woodhouse - Change of use to office and storage.
  • 222 Egmanton Road, Meden Vale - Erection of a two storey rear extension and a single storey front extension (porch).
  • Warsop Vale, JMI School, Carter Lane, Warsop Vale - Outline planning for the development of 14 no. dwellings (including the reserved matter of access). - Objection from Cllr Crawford (Ward Cllr).

Monday 18th January, 2015

The Chairman closed the main meeting and asked for press and public to leave due to a clause under the Local Government (Miscellaneous Provisions) Act 1972 - paragraph 1 and 3. Chairman also asked the Clerk to leave as we would be discussing her terms and conditions - he would invite her back when our discussion was complete.

9397. F&GP meeting - Consideration of staffing issues and contracts:

Office manager Cllr John Kerr explained that he had prepared new contracts with NALC terms and conditions rather than MDC standard contracts. However events this week since our F&GP meeting on 9th November 2016 had surpassed the intended new contract process with the Clerk. He reported several incidents of unacceptable behaviour and read out a number of text conversations he had with the Clerk in recent days. These had culminated in inappropriate comments being made on Facebook and a text to Cllr Kerr resigning as Clerk to the Parish Council.

Cllr Kerr advised that MDC, HR management believed the resignation by text could be accepted by the Council and asked the Council to take that decision.

A discussion took place where two choices of action were possible ways forward.

  • Text resignation of the Clerk to be accepted -Proposed by Cllr Kerr, seconded by Cllr Crawford.
  • To issue a formal warning to the Clerk for inappropriate use of Facebook to criticise the Parish Council (as employer) or Councillors doing their duty. An offer of assistance and counselling where appropriate would be made. Proposed by Cllr Moody, seconded by Cllr Hardy.

Following ballet by show of hands, the Chairman declared:
Motion a) fell - Motion b) was accepted.

Therefore Council had not accepted Clerks text resignation and Chairman would issue the Clerk a formal warning Re: misuse of Facebook.

Cllr Kerr stated that he was disappointed at the decision, feeling he had not been supported by full council and verbally resigned from his position of office manager with immediate effect.

Chairman closed the meeting and invited the Clerk back into the Chambers to complete business by signing minutes and cheques for payment.
